नेता नीचे से बनता है ऊपर से नहीं

 सच्चे नेता की पहचान उसके कार्यों और समाज के प्रति उसकी सेवा भावना से होती है। नीचे से बनने वाले नेता जनता के बीच रहकर उनकी समस्याओं को समझते हैं और उनकी बेहतरी के लिए काम करते हैं। ऐसे नेता जनता का विश्वास और समर्थन अर्जित करते हैं क्योंकि वे ज़मीन से जुड़े होते हैं और उनकी जमीनी वास्तविकताओं को समझते हैं।


स्थानीय स्तर पर नेता बनने का मतलब है जमीनी स्तर से शुरुआत करना, जहां व्यक्ति अपने समुदाय की समस्याओं को समझता है और उनके समाधान के लिए काम करता है। जब नेता जनता के साथ खड़ा होता है, उनकी तकलीफों में शामिल होता है, और उनकी आवाज़ को ऊपर तक पहुंचाता है, तो वह वास्तविक मायने में "नीचे से बना हुआ" नेता कहलाता है।

उत्तराखंड समान नागरिक संहिता अधिनियम, 2024 के तहत, विवाह समारोह उसी परंपरागत तरीके से संपन्न किए जा सकेंगे जैसे अब तक होते आए हैं। चाहे वह “सप्तपदी”, “निकाह”, “आशीर्वाद”, “होली यूनियन” या आनंद विवाह अधिनियम, 1909 के तहत “आनंद कारज” हो, या फिर विशेष विवाह अधिनियम, 1954 अथवा आर्य विवाह मान्यकरण अधिनियम, 1937 के अनुसार विवाह किया जा रहा हो—अधिनियम सभी धार्मिक व प्रथागत रीति-रिवाज़ों का सम्मान करता है। हालाँकि, यह ज़रूरी है कि विवाह के लिए अधिनियम में उल्लिखित बुनियादी शर्तें (उम्र, मानसिक क्षमता और जीवित जीवनसाथी का न होना आदि) पूरी की जाएँ। इससे राज्य के लोगों की सांस्कृतिक विविधता और धार्मिक आज़ादी सुरक्षित रहती है, जबकि विवाह के मूलभूत कानूनी मानकों का भी पालन सुनिश्चित होता है।

*भाग 2: अमान्य (Void) एवं रद्द करने योग्य (Voidable) विवाह*

यद्यपि अधिनियम पारंपरिक विवाह समारोहों को यथावत मान्य करता है, फिर भी यह कुछ ऐसे कानूनी प्रावधान रखता है जिनके तहत विवाह अमान्य या रद्द करने योग्य घोषित किया जा सकता है। यदि अधिनियम लागू होने के बाद संपन्न हुए किसी विवाह में ऐसे तथ्य सामने आते हैं जो अधिनियम में निर्दिष्ट मुख्य शर्तों का उल्लंघन करते हैं—जैसे विवाह के समय किसी पक्षकार का पहले से जीवित जीवनसाथी होना, मनोवैधानिक रूप से वैध सहमति देने में असमर्थता, या निषिद्ध संबंधों के दायरे में विवाह—तो ऐसा विवाह अमान्य (Void) माना जाएगा। ऐसी स्थिति में दोनों पक्षकारों में से कोई भी अदालत में याचिका दायर करके विवाह को शून्य घोषित करने की माँग कर सकता है।

इस संहिता की एक महत्वपूर्ण एवं सकारात्मक विशेषता यह है कि यदि कोई विवाह अमान्य या रद्द करने योग्य घोषित भी कर दिया जाए, तब भी उससे जन्म लेने वाले बच्चे को वैध (Legitimate) माना जाता है। यह प्रावधान बच्चों के कानूनी अधिकारों की रक्षा करता है और परिवार कल्याण के प्रति अधिनियम की संवेदनशीलता को दर्शाता है।
