 लोक अदालत में जाने की प्रक्रिया (Step by Step) 


1. मामले का चयन (Type of Case)

सबसे पहले यह देखना ज़रूरी है कि आपका मामला लोक अदालत में जा सकता है या नहीं।
👉 ऐसे मामले जाते हैं –

  • बैंक लोन, बिजली-पानी बिल, दुर्घटना मुआवज़ा, बीमा विवाद

  • पारिवारिक विवाद, तलाक/भरण-पोषण के समझौते

  • ज़मीन-जायदाद के छोटे विवाद

  • छोटे अपराध (Compoundable offences)


2. आवेदन / रेफरल (Filing or Reference)

लोक अदालत में मामला आने के दो रास्ते होते हैं:

  1. प्रत्यक्ष आवेदन – कोई भी व्यक्ति सीधे आवेदन कर सकता है जिला या तालुका विधिक सेवा प्राधिकरण (Legal Services Authority) में।

  2. न्यायालय से रेफरल – अगर मामला पहले से अदालत में लंबित है, तो अदालत उसे लोक अदालत में भेज सकती है।


3. लोक अदालत का गठन (Formation)

लोक अदालत में आम तौर पर शामिल होते हैं –

  • सेवानिवृत्त जज या वकील

  • सामाजिक कार्यकर्ता या विशेषज्ञ

  • संबंधित प्राधिकरण का प्रतिनिधि


4. सुनवाई (Hearing)

  • दोनों पक्ष बैठकर अपनी बातें रखते हैं।

  • लोक अदालत का माहौल बिल्कुल अनौपचारिक होता है (कोर्ट जैसा दबाव नहीं)।

  • समझौते की कोशिश की जाती है।


5. समझौता / निर्णय (Settlement / Award)

  • अगर दोनों पक्ष सहमत हो जाते हैं, तो लिखित समझौता तैयार होता है।

  • लोक अदालत का फैसला कोर्ट डिक्री (Court Decree) माना जाता है और यह अंतिम होता है।


6. फीस और खर्चा (Fees & Cost)

  • कोई कोर्ट फीस नहीं देनी पड़ती।

  • अगर केस पहले से अदालत में था और लोक अदालत में सुलझा, तो भरी हुई कोर्ट फीस वापस कर दी जाती है।


7. अपील का प्रावधान (Appeal)

  • लोक अदालत के फैसले के खिलाफ आम तौर पर अपील नहीं होती

  • लेकिन अगर समझौता नहीं होता, तो मामला वापस सामान्य न्यायालय में चला जाता है।

 लोक अदालत (Lok Adalat) भारत में न्याय देने की एक वैकल्पिक व्यवस्था (Alternative Dispute Resolution System – ADR) है, जिसे न्यायपालिका द्वारा मान्यता प्राप्त है।

परिभाषा

लोक अदालत का अर्थ है – जनता की अदालत। यह एक ऐसी व्यवस्था है जहाँ दोनों पक्ष आपसी सहमति से, बिना लंबी अदालती प्रक्रिया और खर्च के, अपने विवाद का निपटारा करते हैं।

मुख्य विशेषताएँ

  1. स्वेच्छा (Voluntary): दोनों पक्ष अपनी इच्छा से विवाद सुलझाने आते हैं।

  2. तेज निपटारा: यहाँ मामलों का निपटारा जल्दी होता है।

  3. कम खर्च: यहाँ कोर्ट फीस नहीं लगती। अगर केस पहले से कोर्ट में है, तो फीस भी वापस हो जाती है।

  4. बाध्यकारी (Binding): लोक अदालत का निर्णय अदालत के डिक्री (Court Decree) की तरह अंतिम और मान्य होता है।

  5. अपील नहीं: लोक अदालत के फैसले के खिलाफ आम तौर पर अपील नहीं की जा सकती।

किस प्रकार के मामले लोक अदालत में आते हैं?

  • सिविल मामले (जैसे – पैसों के विवाद, ज़मीन-जायदाद के छोटे विवाद, पारिवारिक मामले)

  • मोटर वाहन दुर्घटना मुआवज़ा मामले

  • बैंक ऋण (Loan Recovery) संबंधी मामले

  • बिजली, पानी, टेलीफोन बिल विवाद

  • श्रम विवाद

  • छोटे-मोटे आपराधिक मामले (Compoundable offences)

कानूनी आधार

लोक अदालत की व्यवस्था वैधानिक रूप से Legal Services Authorities Act, 1987 के तहत स्थापित की गई है।

प्रकार

  • राष्ट्रीय लोक अदालत (संपूर्ण देश में एक ही दिन)

  • स्थायी लोक अदालत (Public Utility Services के मामलों के लिए)

  • तालुका/जिला स्तर की लोक अदालतें

  • मोबाइल लोक अदालतें (गाँव-गाँव जाकर सुनवाई करती हैं)

👉 सरल भाषा में, लोक अदालत वह जगह है जहाँ बिना वकील और अदालत की लंबी प्रक्रिया में पड़े, आपसी सहमति से सस्ता, जल्दी और न्यायपूर्ण समाधान मिलता है।
